Terms and Conditions
1. Provider, scope of application
This website is operated by Velisana GmbH,
Felsenstrasse 98, 9000 St. Gallen, Switzerland
(hereinafter “Velisana”, “we”, “us”).

These Terms and Conditions apply to all orders placed through our online shop. Deviating terms and conditions are not recognised unless we expressly agree to their validity in writing. By using our website or placing an order, you accept these Terms and Conditions as well as our Privacy Policy.

Our online shop is operated via the Shopify platform. 

2. Conclusion of contract
The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.

By submitting your order, you make a binding offer to conclude a purchase contract.
The contract is concluded as soon as we accept your order by sending an order confirmation by email.

3. Products and usage information
Our products are food supplements and not medicinal products.
They are not a substitute for a balanced and varied diet or for medical treatment.

In case of pregnancy, breastfeeding, known medical conditions or the use of medication, it is recommended to seek medical advice before use.
Product images and colour representations may vary depending on the device used. We reserve the right to make changes to product descriptions, assortment and availability.

4. Prices, taxes and payment methods
All prices are final prices.

• For deliveries to Switzerland, prices are stated in CHF including statutory Swiss VAT, plus any applicable shipping costs.
• For deliveries to EU member states, taxation is carried out in accordance with the applicable VAT rates. The applicable tax and all costs are shown in full at checkout.

The available payment methods are shown at checkout. The selected payment method is charged upon completion of the order.

5. Shipping, delivery and transfer of risk
Delivery is made to the delivery address provided by you.

• Shipping within Switzerland usually takes 2–3 business days.
• Delivery times to EU countries may vary and are shown at checkout.

Transfer of risk:

• For consumers in the European Union, the risk of accidental loss or accidental deterioration of the goods passes only upon delivery to the consumer or to a person authorised to receive the goods.
• For deliveries within Switzerland, the risk passes upon handover of the goods to the shipping service provider.

6. Returns & right of withdrawal
Our separate page “Returns & Right of Withdrawal” applies in its current version.

Consumers in the European Union have a statutory right of withdrawal of 14 days. The right of withdrawal expires for sealed food supplements once the seal has been removed after delivery (hygiene and health products).

Only the provisions on the page “Returns & Right of Withdrawal” are authoritative.

7. Warranty
a) Consumers in the EU
For consumers with a delivery address in the European Union, the statutory warranty of two years from delivery of the goods applies. Statutory rights are not limited.

b) Switzerland
The statutory warranty provisions of the Swiss Code of Obligations apply, unless mandatory consumer protection provisions provide otherwise.

8. Liability
We are fully liable:

• in cases of intent and gross negligence
• for damages resulting from injury to life, body or health
• under mandatory statutory liability provisions, for example product liability

In cases of simple negligence, we are liable only for the breach of essential contractual obligations and limited to the foreseeable damage typical for this type of contract.

9. Intellectual property
All trademarks, logos, product names, texts, images and designs on this website are the property of Velisana GmbH or its licensors.
Any use without prior written consent is not permitted.

10. Data protection
We process personal data in accordance with our Privacy Policy.
Since our shop is operated via Shopify, Shopify’s data protection provisions also apply.

11. Customer accounts
If a customer account is created, you are responsible for keeping your login details confidential. You are liable for all activities carried out through your customer account. Transfer of the account is not permitted.

12. Prohibited uses
The website may not be used for unlawful purposes, to distribute harmful software or to impair the functionality of the online shop.

13. Changes, errors and availability
We strive to provide accurate information. Errors, misprints and changes are reserved. We reserve the right to change or discontinue content, prices and services at any time.

14. Dispute resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
Consumers may contact the competent national bodies, in particular:

In Switzerland, there is no statutory obligation to participate in dispute resolution proceedings. Complaints may be addressed directly to us.

15. Applicable law and place of jurisdiction
Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
The place of jurisdiction is St. Gallen, Switzerland.

Mandatory consumer protection provisions of the country in which the consumer has their habitual residence, in particular EU member states, remain unaffected.

16. Final provisions
If individual provisions of these Terms and Conditions are or become invalid, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by the statutory provision.
