Hereinafter referred to as “Velisana”, “we”, “us” or “our”.

These Terms and Conditions apply to all orders placed through our online shop. Deviating terms and conditions shall not be recognised unless we expressly agree to their validity in writing.

By using our website or placing an order, you accept these Terms and Conditions as well as our Privacy Policy.

Our online shop is operated using the Shopify platform.

2. Conclusion of contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.

By submitting your order, you make a binding offer to conclude a purchase contract.

The contract is concluded as soon as we accept your order by sending an order confirmation by e-mail.

3. Products and usage information

Our products are food supplements and not medicinal products.

They do not replace a balanced and varied diet or medical treatment.

In case of pregnancy, breastfeeding, known medical conditions or the use of medication, it is recommended to seek medical advice before use.

Product images and colour representations may vary depending on the device used. Changes to product descriptions, product range and availability are reserved.

4. Prices, taxes and payment methods

All prices are final prices.

• For deliveries to Switzerland, prices are stated in CHF including statutory Swiss value added tax, plus any applicable shipping costs.
• For deliveries to EU member states, taxation is carried out in accordance with the applicable VAT rates. The applicable tax and all costs are shown in full during checkout.

The available payment methods are displayed during checkout. The selected payment method will be charged upon completion of the order.

5. Shipping, delivery and transfer of risk

Delivery will be made to the delivery address provided by you.

• Shipping within Switzerland usually takes place within 2 to 3 working days.
• Delivery times to EU countries may vary and are shown during checkout.

Transfer of risk

• For consumers in the European Union, the risk of accidental loss or accidental deterioration of the goods passes only when the goods are handed over to the consumer or to a person authorised to receive them.
• For deliveries within Switzerland, the risk passes to the customer when the goods are handed over to the shipping service provider.

6. Returns and withdrawal

Our separate page Returns and Withdrawal, as amended from time to time, applies.

Consumers in the European Union have a statutory right of withdrawal of 14 days.

The right of withdrawal expires for sealed food supplements once the seal has been removed after delivery, provided that the goods are not suitable for return for reasons of health protection or hygiene.

Only the provisions on the page Returns and Withdrawal shall apply.

7. Warranty

a) Consumers in the European Union
For consumers with a delivery address in the European Union, the statutory warranty of two years from delivery of the goods applies. Statutory rights are not restricted.

b) Switzerland
The statutory warranty provisions of the Swiss Code of Obligations apply, unless mandatory consumer protection provisions conflict with them.

8. Liability

Velisana shall be liable in accordance with the statutory provisions where liability is mandatory, in particular in cases of intent, gross negligence, injury to life, body or health, and under mandatory product liability provisions.

In all other respects, Velisana’s liability is excluded to the extent permitted by law.

In cases of ordinary negligence, Velisana shall only be liable for the breach of essential contractual obligations. Essential contractual obligations are obligations whose fulfilment is necessary for the proper performance of the contract and on whose compliance the customer may regularly rely.

In such cases, liability shall be limited to the foreseeable damage typical for this type of contract.

Any further liability is excluded.

9. Intellectual property

All trademarks, logos, product names, texts, images and designs on this website are the property of Velisana GmbH or its licensors.

Use without prior written consent is not permitted.

10. Data protection

We process personal data in accordance with our Privacy Policy.

As our shop is operated through Shopify, Shopify’s data protection provisions also apply.

11. Customer accounts

If a customer account is created, you are responsible for keeping your access data confidential.

You are responsible for all activities carried out through your customer account. Transfer of the account is not permitted.

12. Prohibited uses

The website may not be used for unlawful purposes, for distributing harmful software or for impairing the functionality of the online shop.

13. Changes, errors and availability

We endeavour to provide accurate information. Errors, typographical mistakes and changes are reserved.

We reserve the right to change or discontinue content, prices and services at any time.

14. Dispute Resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board, unless mandatory statutory provisions require otherwise.

Complaints may be addressed directly to us. We will make reasonable efforts to resolve customer concerns quickly and amicably.

Mandatory consumer rights remain unaffected.

15. Applicable law and place of jurisdiction

Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

The place of jurisdiction is St. Gallen, Switzerland.

Mandatory consumer protection provisions of the country in which the consumer has their habitual residence, in particular in EU member states, remain unaffected.

16. Final provisions

If individual provisions of these Terms and Conditions are or become invalid, the validity of the remaining provisions shall remain unaffected.

The statutory provision shall take the place of the invalid provision.
